Federal Mexican Government Representations in Foreign Countries:

Federal Maritime Land Zone in Mexico

The granting of the concession and the fees payable for concession of the Mexican Federal Maritime Land Zone (the beaches) are determined in basis of the Federal Rights (fees, duties) Law of Mexico and the Federal Assets and Patrimony Law of Mexico. The fee is determined on a per annum basis using the total sum of meters square multiplied by the fee (set for that location and type of use) and then a separate fixed fee is added to that.

The types of use are the generic "ornato" (ornate, adornment or for just enjoying), protection, construction and others.

In Puerto Vallarta, the "ornato" base calculation fee is $17.00 Pesos (aprx. 1.7 dls US) per meter squared per annum. The other categories in Puerto Vallarta are $47.00 Pesos ($4.70 dls US) per meter squared per annum. If you have a beach front of 20 meters and the depth of the beach is 20 meters (from high mean tide inland), the total number of meters is (20 x 20) 400. Multiplying the sum of $17 Pesos by 400 meters square, the result is $6,800.00 Pesos (aprx. 680.00 dls US)per annum (adding to this the fixed fee).

The filing process is done through the Environmental Protection Agency of Mexico, under its Office of the Federal Maritime Land Zone. s: Services connected to the railroad sector, that consist in services to passengers, maintenance and rehabilitation of rail ways (tracks), easements, repair shops for tractive and pulling (dragging) equipment, organization and commercialization of unitary trains, operation of interior freight terminals railroad telecommunications.

a: Through December 17, 1995 - 0% Foreign Investment.
b: From December 18, 1995 through December 31, 20000 - Up to 49% Foreign Investment.
c: From January 1, 2001 through December 31, 2003 - Up to 51% Foreign Investment.
d: From January 1, 2004 and thereafter - Up to 100% Foreign Investment, without prior requirement of a favorable resolution from the National Commission on Foreign Investment.

-B. ACTIVITIES OF FABRICATION AND ASSEMBLY OF PARTS, EQUIPMENT AND ACCESSORIES FOR THE AUTOMOTIVE INDUSTRY.
a: Through December 31, 1998 - Up to 49% Foreign In- vestment (Subject to that set forth in the Decree for the Development and Modernization of the Automotive Industry).

-C. ACTIVITIES OF PROVIDING THE SERVICES OF VIDEOTEXT AND COMMUTATION IN PACKAGE.

b: From July 1, 1995 and thereafter - Up to 100%, without the prior requirement of a favorable resolution from the National Commission on Foreign Investment.

D. EDIFICATION, CONSTRUCTION AND INSTALLATION JOBS.

6. IF NOT IN ANY OF THE PRECEDING CATEGORIES AND THE INVESTMENT BY FOREIGN INTERESTS IS LESS THAT $85 MILLION NEW PESOS (this amount may have changed), THEY MAY PARTICIPATE AT WILL. IF THE INVESTMENT IS GREATER THAN $85 MILLION NEW PESOS (this amount may have changed), THEN PERMIT IS REQUIRED FROM THE NATIONAL ON FOREIGN INVESTMENT TO EXCEED 49% INTEREST.
